Black Market Entertainment, LLC. Policy Concerning Unsolicited Submissions

1. Black Market Entertainments (“BME”) does not accept and/or review unsolicited creative material of any kind, including, but not limited to, any artwork, audiovisual work, characters, formats, concepts, drawings, ideas, musical compositions (including lyrics), photographs, pitches, program formats, reels, scripts, sound effects, sound recordings, stories, suggestions, videos, visual effects, and/or other similar works (collectively, “Unsolicited Material”).

2. At BME’s sole discretion any Unsolicited Material sent to BME, its affiliates and personnel by any means whatsoever will be immediately deleted, destroyed and/or returned unread. Based on the foregoing, it is understood and agreed that any similarity between any Unsolicited Material and any element in any BME creative work would be purely coincidental.

3. If despite this policy governing Unsolicited Material treatment by BME, you do transmit or send any Unsolicited Material to BME, you hereby acknowledge and agree that: BME assumes no obligation to treat as confidential Unsolicited Material sent to BME and will not be liable for any use or disclosure;

a. BME assumes no obligation to treat as confidential Unsolicited Material sent to BME and will not be liable for any use or disclosure;

b. The Unsolicited Material will automatically become the exclusive property of BME;

c. BME will have the unfettered right throughout the universe in perpetuity, without any credit, compensation, or notice to you, to protect Unsolicited Material as its own asset, use, reuse, modify, alter, display, archive, publish, license, perform, reproduce, disclose, transmit, broadcast, post, sell, translate, create derivative works of or distribute in all media formats now known or hereafter devised for any purposes whatsoever, commercial or otherwise;

d. You hereby waive any moral rights you may have in and to any of your Unsolicited Material, even if such material is altered or changed in a manner not agreeable to you;

e. You waive the right to make any claim against BME, its parents or affiliates relating to or arising out of BME’s actual or alleged exploitation or use of any Unsolicited Material, and;

f. The rights hereby granted to BME cannot constitute the basis for any claim for unjust enrichment against BME should BME elect to use Unsolicited Material.
